These Terms & Conditions (“Terms”) apply to all floral products and services provided by Florist & Home Samantha. By placing an order, booking a consultation, or using our website, you agree to be bound by these Terms. If you place an order on behalf of another party, you confirm that you are authorised to accept these Terms for them.
Orders are confirmed once full payment or an agreed deposit has been received. Event balances are due at least seven days prior to delivery unless otherwise arranged in writing. We accept secure card payments, bank transfer, and approved partner platforms. Event proposals remain valid for 14 days and may change after that period. If a requested stem becomes unavailable we substitute with equal or higher value florals that honour the agreed palette.
We deliver across Marbella, Mijas, Estepona, and neighbouring areas. Delivery charges, access details, and timing windows are confirmed at booking. Accurate delivery information and recipient availability are your responsibility. If delivery cannot be completed due to incorrect details or lack of access, additional fees may apply for a second attempt. Studio collections are by appointment; orders not collected within 24 hours may be cancelled without refund to maintain product freshness.
For weddings, villas, and large installations we provide bespoke design boards, quotes, and schedules. Final counts and styling decisions must be confirmed 14 days before the event. Additional labour fees may apply for complex set-ups, late-night breakdowns, or venue requirements. Clients are responsible for securing venue access, workspace, water supply, and storage areas. Damage to hired props or décor will be invoiced at replacement value. We are not liable for delays or cancellations caused by circumstances beyond our control (e.g. extreme weather, governmental restrictions).
Fresh florals are perishable and require appropriate care. We provide handling guidance with every order. Once delivered or collected, responsibility for their condition transfers to you. We cannot guarantee longevity if blooms are exposed to excessive heat, direct sunlight, or insufficient hydration.
All original designs, photography, copy, and branding created by Florist & Home remain our intellectual property. Clients may share professional imagery featuring our work with appropriate credit. Any commercial usage, media distribution, or reproduction requires prior written consent.
Our liability for any claim is limited to the amount paid for the relevant goods or services. We are not liable for indirect or consequential losses, including loss of profit or event-related costs. Nothing in these Terms excludes liability for death or personal injury caused by negligence or for fraudulent misrepresentation.
These Terms are governed by the laws of Spain. Any dispute will be subject to the exclusive jurisdiction of the courts of Marbella, Málaga. You may also pursue alternative dispute-resolution procedures as provided by European Union consumer protection laws.
